We at TucsonsCorruptLeadership.com are usually pointing out the negative crap that Tucson cops, as well as the Tucsonans they protect, have to deal with. As you read through this investigation, it will be crystal clear to you that AZ POST Compliance Manager, Mike Giammarino, is either corrupt or incompetent. We're not really sure if AZ POST Compliance Specialist, Catherine Hawse, is corrupt or incompetent or is she just too weak to stand up to her boss? Let's also keep in mind that there was another incompetent or corrupt individual who was a part of this investigation named Ben Henry. We now know he transferred to the state's liquor board as part of Governor Hobbs's administration right after this debacle.
The way AZ POST personnel handled this investigation stunk from the beginning. We believe the evidence proved SGT Jimmy Scott and his date, Corina Switzer, had sexual contact in his marked patrol car several times while he was on duty. So how the hell could the decision be made to close this investigation "without initiating proceedings?"
I took another look at the AZ POST command structure and saw that the corruption and/or incompetence has come from the AZ POST Compliance Personnel. Specifically, Compliance Specialist, Catherine Hawse, Compliance Manager, Michael Giarmmarino, Compliance, and Executive Directors, Matthew Giordano and Ben Henry. After reviewing my correspondence with these individuals, it is clear that THIS is where the cover up occurred.

So who do these people answer to? Good question. The answer is the AZ POST Board Members. Mr. Giordano, the Executive Director, handles the day to day operations at AZ POST. The Executive Director serves at the pleasure of the AZ POST Board Members. Since we knew the AZ POST Compliance Personnel was corrupt or incompetent, we went to the board.
On June 28, 2024 at 0952 hours, I sent the following email to Cochise County Sheriff Mark Dannels and Mohave County Sheriff Schuster.
Sheriff Mark Dannels & Sheriff Doug Schuster,
I am reluctantly contacting you with a matter involving AZ POST that I wish did not need to be addressed. I have submitted a public record request for the email addresses for the entire AZ POST board. When I receive this information, I will inform the entire board of what you are about to read.
As long as I have worked in law enforcement, over 25 years, I have always known AZ POST to set the standards for peace officers in the State of Arizona. That belief is now in question based on a recent experience.
I was made aware of an incident involving a sergeant with the Tucson Police Department who, over a period of 4-5 months, had sexual contact with an off-duty Tucson Police Dispatcher who was the sergeant's pregnant wife. These encounters occurred while the sergeant was on-duty, he was in uniform, he was in a marked patrol car, and he was in an area that was open and accessible to the public (city park). This sergeant and his date were actually caught "messing around" by a Tucson community member who made a complaint.
Once he was caught, this sergeant lied about his involvement multiple times before finally admitting to "hugging, kissing, buttocks grabbing, and genital groping."
The sergeant's chain of command decided the appropriate punishment was termination. Multiple commanders mobilized and quickly removed termination as a possible punishment. It was agreed to by everyone involved that this sergeant was incapable of working without direct supervision, so he was to be demoted to the rank officer. Then, miraculously, he was not demoted, he was given a 40-hour suspension.
I notified AZ POST about this incident, or more accurately, this series of on-duty sex crimes. I was advised that I had to rethink my complaint to fit the administrative law that is relevant to AZ POST. I submitted my complaint about the on-duty sergeant who had sexual contact while on duty and then lied about his actions. Unfortunately, my complaint was closed "without initiating proceedings." I believe this was absolutely the wrong answer.
As I stated earlier, I will make this information available to the entire board when my request for their emails is fulfilled. I contacted both of your offices, and I was provided with these email addresses. I chose you two because you are the elected officials on the board. I am aware AG K Mayes is also on the board, and she is an elected official but unfortunately, when I tried to make this information available to her office, there was not the least bit of interest.
Again, in my decades of law enforcement in the State of Arizona, AZ POST always stood as the firewall that prevented a dishonest cop from continuing with their corrupt career. AZ POST could always stop that career even if that corrupt cop was "in good" with their department. Regarding this series of incidents, AZ POST has completely failed all Arizona Peace Officers as well as the citizens they protect. I would hate to think that AZ POST has become a rubber stamp that allows corrupt departments to continue to employ dirty cops. I hope this can be fixed.
The corruption in the City of Tucson Government has compelled me to establish a website ( Tucsonscorruptleadership ). I have already documented these on-duty sex crimes and the subsequent coverups. I invite you to see for yourself.

Good Evening Mr. Voss,
To begin, I appreciate you reaching out to us reference your frustration regarding the content of your email. The best way to address a wrong is to acknowledge it and ensure those empowered to address it fulfilled their expectation within the authority of their position.
As the AZPOST Chair, I am unfamiliar, or do not recall hearing this complaint as described. I will inquire into this matter on Monday with Executive Director Matt Giordano for an update, note -- I cc’d him on this email too.
I can assure you, the membership and staff of AZPOST address all complaints in a manner of consistency and within procedures set and governed by the POST board. My tenure on the board both as a member and now as the chair has been rewarding based on these objectives to do what’s right and required. Transparency supported by the leadership of Director Giordano, our legal advisors, and the depth of experience and talent by the appointed board members serving our public safety partners promotes these successes.
I have no issue with sharing the content of your of email to my fellow board members to ensure they hear your concerns too. We don’t rubber stamp cases, we provide equal representation for all involved and based on the facts and our established rules, a decision is applied.
Either I, or Director Giordano will reach back out to you with an explanation to the status of this complaint.

There are two points I would like to make about this response. The first thing is the timing. I sent my email on a Friday morning. Sheriff Dannels answered the next day (Saturday evening). To me that says that Sheriff Dannels is a serious who takes his position as Sheriff just as serious as he takes his position as Chairman of the AZ POST Board. The second point is Sheriff Dannels stated he was unaware of this series of sex crimes committed by an on-duty sergeant. I could be wrong but that is the type of investigation that tends to stick in one's memory. That confirms my belief that the AZ POST Compliance Personnel can make one of these investigations just go away without the advising the Board of what actually happened.

Good Afternoon Officer Voss,
I am in receipt of the email you sent to Sheriff Dannels and Sheriff Schuster. As you know, I am familiar with the complaints you lodged against fellow / former members of the Tucson Police Department. I am also familiar with and proud of the transparent process AZPOST uses to address complaints we receive. In the matter you referenced to the Sheriffs, I am confident we thoroughly reviewed the documentation provided by the Tucson Police Department as part of the internal investigation they completed in 2018. Based on our review of the information, the misconduct did not rise to the level of a violation of AZPOST rules. We communicated this to you in a letter dated November 29, 2022 (a copy is attached).
We are not aware of additional or new information which was not available to the Tucson Police Department in 2018 or to AZPOST in 2022 which would change our assessment. Therefore, we will have no further correspondence with you regarding this matter.
The last line in this corrupt man's response says a lot. He has now cut off future correspondence. How transparent...
I responded with this email to Sheriffs Dannels and Schuster as well as the corrupt Matthew Giordano.
I appreciate you getting back to me so quickly. I do not agree with your decision to sign off on months and months of on-duty sex acts committed by a supervisor who was on duty, in uniform, in a marked patrol car, and in an area that was open and accessible to the public. I will also remind you that AZ POST has denied 7 certifications, suspended 28 certifications, and revoked 27 certifications for sexual misconduct. I believe these numbers are for the last 10 years.
I hope it is clear that I know that what SGT Scott did was wrong as was the cover up carried out by corrupt members of the Tucson Police Department. It should also be clear that I will not let this go. At some point in the near future, the question of “what did you know, and when did you know it?” will be asked to the people involved with this investigation. I hope that you are comfortable with your answer.

**THIS INVESTIGATION IS ON GOING AND I WILL BE ADDING TO IT AS I CAN**
I presented the actions and the inactions of Sergeant James Scott to AZ POST. Initially, AZ POST personnel seemed like they were interested. They requested I change the entire format of my complaint against SGT Scott and the Rat Squad that protected him to show his AZ POST violations (I was told the criminal charges meant nothing to them). Unfortunately, they folded pretty quickly and then initiated an investigation AGAINST ME!!
I will show who was involved by their names and photos (I requested the department photos of these corrupt people). I will also show the emails involving POST personnel as well as the emails to the Tucson Police Department Executive Leadership Team. If you work for the Tucson Police Department, prepare to be very disappointed.
IT'S ALL ON THE WAY!!
I made a public record request to AZ POST in January 2024. I wanted to know how many Peace Officers in Arizona have had their POST certifications suspended, revoked, or denied for sexual misconduct. If I am not mistaken, I requested AZ POST to go back 10 years in their records. This was their response.

Your request for information regarding the number of cases involving sexual misconduct has been completed. The number of peace officers who have had their certification suspended, revoked, or denied are:
Suspended: 28
Revoked: 27

We already knew that AZ POST is supposed to set the standard for law enforcement in Arizona. In fact, according to their own website, in the area under the heading of "What We Do," they claim "The Arizona Peace Officer Standards and Training Board stands to foster public trust and confidence by establishing and maintaining standards of integrity, competence, and professionalism for Arizona peace officers and correctional officers."
When we apply the actions and inactions of Sergeant James Scott of the Tucson Police Department and his date, off duty dispatcher, Corina Switzer, how they hell did AZ POST decide to "close this complaint without initiating proceedings?"

I made contact with Catherine Hawse, an AZ POST Compliance Specialist. On July 29, 2022, we had a Zoom meeting and I advised her of the actions, as well as the inactions of Sergeant James Scott of the Tucson Police Department to include the series of sex crimes committed by SGT Scott and his companion.
After this meeting, I had several conversations, mostly over emails, with Catherine Hawse about how to present this information to AZ POST. Catherine Hawse advised me that I was thinking about this complaint the wrong way. She told me that I needed to forget about the criminal aspect of this complaint. AZ POST only cared about the administrative violations committed by Sergeant James Scott. She sent to me the Arizona Administrative Code (21 pages of Arizona administrative law).
I rewrote my complaint. It is posted below.
This was sent to Catherine Hawse on August 22, 2022
Sergeant James Scott #52267 of the Tucson Police Department was involved in a sexual relationship with a Tucson Police Department Communications Dispatcher over the period of several months (March or April 2018 to August 2018). SGT Scott and his companion met while she was off duty and SGT Scott was on-duty, in uniform, in a marked patrol car, and in an area that is open and accessible to the public. During these meetings, SGT Scott and his companion committed several acts of Public Sexual Indecency (13-1403, a class 1 misdemeanor). This series of incidents were investigated by the Tucson Police Department Office of Professional Standards under OPS #18-0476.
This document will serve as my complaint against the actions of SGT James Scott of the Tucson Police Department. His actions as well as his inactions show that he has violated the public’s trust and he should no longer be an Arizona POST Certified Police Officer. I believe that SGT Scott’s AZ POST Certification should be permanently revoked.
I thank you for your time and I appreciate your attention to this matter.
The Sex Acts
Over a period of several months, SGT James Scott of Tucson Police Department engaged in a sexual relationship with a Tucson Police Department Communications Dispatcher. SGT Scott and his companion met several times while he was on-duty, in uniform, in a marked patrol car, and in an area open and accessible to the public (Reid Park). During these meetings, on several occasions, SGT Scott admitted to “hugging, kissing, buttocks grabbing, and having his genitals groped.” These facts were discovered in Tucson Police Department Office of Professional Standards interviews with SGT Scott as well as his companion. The facts of this investigation presented in this complaint are not contested by anyone involved in this investigation. They are irrefutable.
The behavior of SGT Scott and his companion perfectly fit the statute of public sexual indecency (ARS 13-1403).
ARS 13-1403/ Public Sexual Indecency:
A. A person commits public sexual indecency by intentionally or knowingly engaging in any of the following acts, if another person is present, and the defendant is reckless about whether such other person, as a reasonable person, would be offended or alarmed by the act:
1. An act of sexual contact.
2. An act of oral sexual contact.
3. An act of sexual intercourse.
4. An act of bestiality.
3. "Sexual contact": (a) Means any direct or indirect touching, fondling or manipulating of any part of the genitals, anus or female breast by any part of the body or by any object or causing a person to engage in such contact.
SGT Scott and his companion were caught “messing around” by a citizen who later made a complaint. When asked what SGT Scott’s companion’s position with the department was, she stated she was a “future TPD officer.” What was this complainant’s perception of the professionalism of the Tucson Police Department or any law enforcement agency at this time?
AZ Administrative Code R13-4-109. Denial, Revocation, Suspension, or Cancellation of Peace Officer Certified Status
A. Causes for denial, suspension, or revocation. The Board may deny certified status or suspend or revoke the certified status of a peace officer for:
7. Committing a felony, an offense that would be a felony if committed in this state, or an offense involving dishonesty, unlawful sexual conduct, or physical violence;
12. Engaging in any conduct or pattern of conduct that tends to disrupt, diminish, or otherwise jeopardize public trust in the law enforcement profession.
The actions of SGT Scott violated rule 7, not 1 single time, but multiple times over a period of several months. His actions fit the requirement for ARS 13-1403, Public Sexual Indecency. The fact that these crimes were committed by an on-duty uniformed police officer, in a marked patrol car, in an area open and accessible to the public is appalling. The fact that these crimes were committed by a sergeant, who at a minimum, is responsible for a squad of officers, is nothing short of sickening.
As the criminal sex acts committed by SGT Scott were intentional, he committed malfeasance, or more accurately, several counts of malfeasance as these sexual encounters with his companion, occurred several times.
The Falsified Case Report
On July 16, 2018, SGT Scott’s companion was jogging around Reid Park (the location of most of their “meetings”). The suspect, a juvenile male subject, had approached women on the track. The suspect approached these women and asked them for a date and he attempted to kiss their hands. As SGT Scott’s companion was running around the track, she was contacted by this male subject. SGT Scott’s companion called SGT Scott, not 911, to report this incident. SGT Scott located the suspect and later found that the suspect had previously committed similar sexually motivated incidents at his school. SGT Scott completed a police report to document this incident that was less than factual. The suspect, who was a minor at the time of this incident, was released to his mother.
SGT Scott wrote in his report that he was “flagged down,” by the victim and that “the victim did not identify herself.” These are lies. SGT Scott was called directly on his phone by the victim. SGT Scott knew the victim; he was having an affair with her. It is apparent that SGT Scott wanted to conceal his relationship with his girlfriend so he falsified his report and documented information he knew to be false.
What I believe is far worse than the factually incorrect official police report, is the fact that SGT Scott did not disseminate this information to the appropriate investigative units. I believe it is common knowledge amongst the law enforcement community that sex offenders are very unlikely to commit one offense and never offend again. These offenders, like the one located by SGT Scott on July 16, 2018, offend multiple times. In his case, he victimized two women on the night he was located by SGT Scott. They also learned that this suspect previously committed similar crimes at school! SGT Scott should have notified the supervisor of that investigative unit that night. He could have at the very least sent an e-mail. He did not. The notification did not occur until September 25, 2018 and that notification came from Tucson Police Department’s Office of Professional Standards over two months later.

SGT Scott’s actions as well as his inactions are certainly a violation of his duties as a police officer. He ignored the importance of disseminating information on a sex offender to where it needed to go and he created a report that he knew was not accurate. This is in addition to the sexual misdemeanors he committed on-duty with his date on multiple occasions.
The Investigation
SGT Scott was interviewed by the Tucson Police Department’s Office of Professional Standards. He was questioned specifically about sexual contact between him and his companion. To this, he answered, “sex no, sexual, maybe we should clarify what’s, I, like what do you mean sexual activity?” He then asks “where does a kiss fall?” When SGT Scott was specifically asked about sexual activity, groping, and making out, he stated, “nothing more than the park kissing. So, maybe kissing, yeah.” Later in that interview, SGT Scott is asked if his companion ever grabbed his groin. He admitted that his companion did in fact grab his groin “purposefully” and in a “sexual manner.”
SGT Scott lied about his part in this series of on-duty sex crimes until he was cornered and finally admitted what he did and what was done to him. It is these actions that make SGT Scott and his companion guilty of Public Sexual Indecency. It appears that SGT Scott was aware of his actions and wanted them concealed. Remember, earlier in this interview, SGT Scott stated nothing beyond kissing occurred between him and his companion. He then admits that he had his genitals groped.

The actions of SGT Scott clearly qualify as Malfeasance. His actions were willful and intentional. His actions perfectly fit ARS 13-1403. Sadly, many people in the State of Arizona do the same thing that SGT Scott did with his companion but are arrested and prosecuted. This is unconstitutional as it does not provide for equal protection under the law.
After we presented what we believe to be overwhelming evidence to AZ POST, this was the email we received from Catherine Hawse...
AZ POST closed my complaint against SGT James Scott of the Tucson Police Department, but they also closed the "complaint master file" THEY CREATED ON ME!! That's right, you can make a complaint on a police supervisor and their truly despicable behavior and AZ POST, the organization who "stands to foster public trust and confidence by establishing and maintaining standards of integrity, competence, and professionalism for Arizona peace officers and correctional officers," and AZ POST personnel may investigate YOU!
I have posted the letter that notified Chief Kasmar about the closure of this AZ POST investigation. I have also posted the letter that advised me that I was off the hook.
It appears the ridiculous decision to close these investigations without initiating proceedings was made by AZ POST COMPLIANCE MANAGER, MICHAEL GIAMMARINO.
