This is an investigation we were made aware of and decided to look into it. This story is not new to a lot of people, as it was previously reported here. We decided to conduct a public records request for the body-worn camera footage of one of the officers involved. After over a year, we received the video. It is posted below. We also posted the actual letter delivered to Councilor Regina Romero's Ward 1 office, as well as the case summary from the Tucson City Court.
**A public record request was made for the ensuing investigation conducted by Mr. Voss's employer at the demand of Mayor Regina Romero. This record request was made on August 28, 2020 and we finally got it! To fully document what happened we decided this was big enough to be its own investigation. Dear Councilor,
I write to you as registered voter, a tax payer, and a denizen of the City of Tucson. The City of
Tucson has a traffic fatality problem. Year after year, for the last several years, we have been
losing more people than the previous year. Many of these traffic fatalities are alcohol related.
On September 29, 2017, Tucson Police Officers arrested Margarita Romero- Durazzi for multiple
DUI offenses. Margarita had a blood alcohol content that was two and a half times the legal
limit, she repeatedly calls a female police officer a “bitch,” and she mentions the fact that her
sister is a city councilwoman with the City of Tucson.
I looked on the Tucson City Court website and found no record of Margarita’s arrest when I
looked her up by name. However, when I entered the docket number, Margarita’s name and
the details of her arrest were accessed. I found it odd that I could not access Margarita’s
information by name so I searched for the records of three Tucson Police Officers (current and
former) who had been arrested within the city limits of Tucson. What I found when I looked
them up by name was all of the details of their case, I could see if they pled guilty or not guilty,
and I could see if they had been current when paying their fines. Margarita was charged with
four DUI offenses. Court records show three of the charges, the three most severe charges,
were dismissed by the prosecutor.
I decided to request the body worn camera footage through a public records request. After
approximately 14 months, I received the video. What I saw was a person who was extremely
intoxicated. She was unbelievably rude and I can not see how any of the DUI charges were
dismissed. I’m just glad the officers were able to intervene before she got on the road.
This leaves me with a question to which I would like an answer. Should everyone in America
receive equal protection under the law as guaranteed by the US Constitution Fourteenth
Amendment or should justice be administered based on the defendant’s last name, influence
from family members or anything other that the facts of the case?
I have enclosed a copy of the case summary from Tucson City Court as well as a copy of the
body worn camera footage of the incident.
